STEPHEN W. SATHER

STEPHEN SATHER received his B.A. degree (summa cum laude in economics and political science) from Texas Lutheran University and his J.D. (with honors) from the University of Texas School of Law. He was admitted to the Texas Bar in 1986. He is also admitted to practice before the United States Supreme Court, the United States Court of Appeals for the Fifth Circuit and the United States District Courts for the Northern, Southern, Eastern and Western Districts of Texas and the District of Colorado. He is Board Certified in Business Bankruptcy Law by the Texas Board of Legal Specialization and the American Board of Certification. He is a member of the State Bar of Texas, the American Bar Association, the Travis County Bar Association and the American Bankruptcy Institute and the Commercial Law League of America. He is the President-Elect of the Bankruptcy Section of the Austin Bar Association after having served as Treasurer for five years. He has been selected as a 2006 Texas Super Lawyer by the publishers of Texas Monthly and Law and Politics.

Mr. Sather is a frequent author and speaker on bankruptcy topics and has been invited to present papers to conferences sponsored by the University of Texas School of Law, the State Bar of Texas, the National Association of Attorneys General, the States Association of Bankruptcy Attorneys and the United States Justice Department (U.S. Trustee, Region 7). Mr. Sather also wrote a series of columns on Shakespeare for Lawyer for the American Bankruptcy Institute Journal between 1994-1998.

Mr. Sather represents debtors, creditors, trustees and committees in bankruptcy cases. He has represented clients under chapters 7, 9, 11, 12 and 13 of the Bankruptcy Code. He has successfully reorganized or sold many businesses in bankruptcy, including a software developer, a marina, two Austin churches, a national chain of pizza restaurants, four Williamson County road districts, a firearms manufacturer, and companies in the high tech, telecommunications, manufacturing real estate, and retail sectors. His creditor clients include banks, landlords and judgment creditors. He represents bankruptcy trustees in several districts and has pursued hundreds of adversary proceedings on behalf of trustees and other parties. Mr. Sather has represented clients in over a dozen appeals to the Fifth Circuit, resulting in published opinions such as Matter of Gupta, 394 F.3d 347 (5th Cir. 2004); Matter of CompuAdd Corporation, 137 F.3d 880 (5th Cir. 1998), In re Educators Group Health Trust, 25 F.3d 1281 (5th Cir. 1994); Matter of Dyke 943 F.2d 1435 (5th Cir. 1991)and Matter of Greystone III Joint Venture, 995 F.2d 1274 (5th Cir. 1991).

 Mr. Sather is a volunteer mediator for the Travis County Dispute Resolution Center. He has served as a Travis County Election Judge. He served six years on the School Board of St. Martin’s Lutheran School, including two years as Board Chairman. He is presently Vice-President Div. III of the Austin United Capitals Soccer Club and has also served as a commissioner and coach. He plays for the Blue Hurricanes in the parents’ league of the Austin United Capitals Soccer Club.
